Terms
Effective from —
§ 1. Service Provider and Definitions
- The Triparo.eu (https://triparo.eu) service is run by [operator_name], [operator_address], [operator_ids] ("Service Provider", "us"). Contact: [contact_email].
- The terms and conditions set out the rules for providing services via the service website. User means any person using the service; Account — a user's account on the service; Listing — a place described in the directory (accommodation, restaurant, attraction, etc.); User Content — opinions, ratings, photos, replies, reports and suggestions added by the user.
- Data processing principles are outlined in our Privacy Policy.
§ 2. Services
- Without an account you can: browse the directory and map, search, save favorites and plan your trip (data is stored in your browser or session).
- With an account you can also add opinions and ratings, send photos, rate helpfulness of opinions, report new listings, save journeys and favorites to your account, share the journey via a link.
- The owner or manager of a listing may take over the listing after verification: propose changes to data, send photos, reply to reviews and see statistics for the listing.
- All services are free. We do not mediate in bookings or payments — we are not a party to agreements between you and the listing.
- To use the service, you need an internet-connected device with a current browser that has JavaScript and cookies enabled; to create an account, you also need an email address.
§ 3. Account
- An account may be created by someone who is 16 years old or older. The agreement for maintaining the account comes into effect upon registration and acceptance of these terms, indefinitely.
- You provide a genuine email address and keep your password secure. One person — one account.
- At any time you may delete your account (Account → "Your Data"), which terminates the agreement.
- We may suspend or delete an account that grossly or persistently violates the Terms of Service or the law (e.g., publishing fake reviews, spam). We will notify you with an explanation at your account's email address, unless prohibited by law.
§ 4. User Content Guidelines
- It is prohibited to publish illegal content, as well as: offensive, hate-promoting, or vulgar content; advertisements and promotional links; other people's personal data (e.g., phone numbers, employee names); content that infringes on copyright or personal rights.
- A review must describe your own experience with the establishment. Opinions ordered or paid for, issued to the object by its owner, employees, or related persons, as well as opinions about competitors written to harm them are prohibited.
- You can upload photos if you have the rights to them (e.g., you took them yourself) and they do not portray in a recognizable way people who did not consent.
- Opinions, photos, responses to opinions, object reports, and change proposals are checked by moderation before publication. We may refuse publication or remove content that violates the terms or law — we inform the author with justification.
§ 5. User Content License
- Rights to your content remain with you. By adding them, you grant us a free, non-exclusive, worldwide license to publish your content in the service and its public API, translate (including automatically), adapt the format (e.g., resize photos, remove metadata), and use excerpts in search results and on service pages — for the duration your content is in the service.
- For photos, we attribute your displayed name as the author ("sent by"). After account deletion, content may remain without author attribution, unless you choose to delete content along with the account.
- You can earn points for accepted photos. Points have no monetary value and are not exchangeable, unless the service clearly announces exchange rules.
§ 6. Opinions and Ratings — How They Work
- We do not verify if the opinion author actually used the object. To limit false reviews: we require accounts with verified email addresses, one account can add one opinion about an object, each opinion undergoes automatic spam risk assessment and moderation before publication.
- Object rating is the average of published opinions, adjusted for objects with few reviews (to prevent one rating from determining the result).
- The object owner can respond to an opinion (the response also undergoes moderation), but cannot delete or edit it. Anyone can report opinions violating the law or terms (§ 9).
§ 7. Triparo Rating
- Triparo rating is a score given by the service inspector after visiting the object, based on published criteria. The object does not pay for the review and has no influence on its content.
- The owner may publish a response to the review and request a re-inspection, providing justification.
§ 8. Order of results, prices and data sources
- Default object order on lists and in search depends on: editorial rating, Triparo rating, completeness of the object's data (e.g., photos, description, hours of operation, contact details) and review score. In the “Nearby” section, distance, category match, popularity, and verification status of the object also count. You can change the sorting (e.g. by price or rating).
- No one pays for a position on the list. Advertisements, if they appear, are marked with the word "Advertisement".
- The data of objects comes m.in. from OpenStreetMap, Wikimedia Commons, public registers of companies, from the owners of the objects and users (details: page "Data and licenses"). They may be outdated - check the key information (prices, opening hours) at the object before your trip.
- Prices have an informative character. Prices converted to another currency are marked with "≈" and calculated based on the average exchange rate of NBP.
§ 9. Reporting contents not in accordance with the law
- Anyone can report content that they consider to be in conflict with the law or regulations by writing to [contact_email] (topic: "Content Report"). The report should include: the address of the page with the content, explanation of why the content is not in accordance with the law, name and surname (or name) and email address of the reporter, as well as a statement that the report was made in good faith.
- We confirm receipt of the report, review it promptly and inform the reporter about the decision. The author of removed or limited content receives the justification of the decision and can appeal against it by responding to the message.
- This same address is a contact point for member states' authorities, the European Commission, and users within the meaning of the Digital Services Act (DSA). We correspond in Polish and English.
§ 10. Complaints
- Complaints about the service's operation should be reported to [contact_email], describing the problem and providing an email address for a response.
- We respond within 14 days.
- The consumer can use extrajudicial methods of dispute resolution, e.g. help from a local or county consumer advocate or the District Trade Inspection Office.
§ 11. Liability
- The service has an informative character. We are not liable for services provided by facilities or for content added by users and owners, unless we were aware of its unlawful nature, in which case we immediately disabled access to it upon becoming aware.
- We make every effort to ensure the service operates without interruptions; however, interruptions may occur due to technical maintenance or failures.
- The provisions of these Terms do not exclude or limit consumer rights arising from mandatory legal provisions.
§ 12. Amendments to the Terms and Final Provisions
- We may amend the Terms for valid reasons (changes in legislation, changes in service features). We will inform account holders about these changes by email at least 14 days before they come into effect; if you do not agree with them, you can delete your account.
- Polish law is applicable; this does not deprive the consumer of the protection afforded by the laws of the country where he usually resides.
- The regulations will be in force from —.
